DefaultAccess failure

I am experiencing trouble with incorrect access designs from time to time. I am using svn 2424,

If a user's first visit is to an incorrect url they will see the ezp standard design for errors, in this case Error / kernel (3).
I have site.ini correctly set with a DefaultAccess=mydesign so why does this happen?

I tried the Patch for "user/login/site [siteaccess] error" bug but it didn't work for me, if I applied correctly that is, I think I did?
patch access.php access.php.patch

Any ideas what my problem is?
